The celebration itself provides codes and keys to enable the catechumens, neophytes and faithful to discover, little by little, the mystery that is celebrated there. A popular principle about grounding, “Internality”, says that if A grounds B, then necessarily, if A and B obtain, then A grounds B. I argue that Internality is false. Its falsity reveals a distinctive, new kind of explanation, which I call “ennobling”. Its falsity also entails that every previously proposed theory of what grounds grounding facts is false. I construct a new theory.

Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. I defend my view from objections, including C. D. Broad's influential “timing” argument, and I (...) conclude with implications for agent‐causal theories of free will. (shrink)

Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. This article evaluates the legality of Operation Iraqi Freedom, the March 2003 attack on Iraq. The author rejects assertions that Security Council Resolution 1441 (2002), standing alone, contained a mandate to employ force; on the contrary, the Resolution was only adopted on the understanding that it did not. The law of self-defense, including its ?preemptive? variant, similarly provided no legal basis for the action because the degree of Iraqi support to terrorism was insufficient and the threat of use of weapons (...) of mass destruction was not imminent. With regard to humanitarian intervention, the suffering inflicted by the Saddam Hussein's regime did not rise to a level allowing intervention. Moreover, international law does not permit forceful regime change except when authorized by the Security Council. However, the author argues that material breach of the 1991 cease-fire in Security Council Resolution 687 released the US and UK from their obligation to refrain from hostilities, thereby reactivating the use of force authorization in Security Council Resolution 678 (1990). This latter justification was the sole official legal justification offered for Operation Iraqi Freedom. (shrink)

A finalidade do texto seguinte consiste na exposição de uma relação de promiscuidade entre a técnica e a ciência na obra de Jean-François Lyotard. A primeira etapa deste artigo consiste na apresentação de um problema referente à obra A condição pós-moderna, onde a noção de técnica aparece sobre uma perspectiva positivista. Aqui, a intimidade entre técnica e ciência é resultado da crise dos fundamentos das ciências na modernidade, crise oriunda do afastamento entre as ciências e os discursos que se prestavam (...) frequentemente à sua legitimação. Esses discursos, que Lyotard aproxima do modelo narrativo, e dos quais se destacam o discurso político de emancipação e o discurso filosófico especulativo, entram em declínio na condição pós-moderna. As ciências, desprovidas de motivações ou destinos humanistas, não resistem à lógica capitalista, e encontram o intermediário de sua relação com o capital na técnica. O critério da ciência deixa, pouco a pouco, de ser a busca pela verdade e passa a ser a busca pelo melhor desempenho. A segunda e conclusiva etapa do artigo, consiste, por sua vez, na radicalização dessa promiscuidade, e se refere principalmente ao livro O inumano. A assim chamada tecnociência corresponde à completa submissão da ciência à técnica: se a visão positivista de A condição pós-moderna vê na técnica um suplemento, uma prótese que dá assistência à pesquisa científica, no segundo livro, a ciência se mostra a prótese ou o suplemento da técnica, que se revela, não obstante, inumana. Nessa segunda parte do artigo, pretendo mostrar que a visão positivista da técnica não é, portanto, suficiente para compreender a relação promíscua que ela tem com a ciência, mostrando-se necessário o recurso à perspectiva clássica da mesma: é a partir da visão da técnica como produtividade cega da physis que alcançamos também o entendimento do caráter inumano da tecnociência. Carl Schmitt, the author of such books as Political Theology and The Crisis of Parliamentary Democracy, was one of the leading political and legal theorists of the twentieth century. His critical discussions of liberal democratic ideals and institutions continue to arouse controversy, but even his opponents concede his uncanny sense for the basic problems of modern politics. Political Romanticism is a historical study that, like all of Schmitt's major works, offers a fundamental political critique. In it, he defends (...) a concept of political action based on notions of good and evil, justice and injustice, and attacks the political passivity entailed by the romanticization of experience. The book has three strands. The first is an attack on received notions of the origins of the Romantic Movement. Schmitt argues that this movement represents a secularization, subjectification, and privatization in which God is replaced by the emancipated, private individual of the bourgeois social order. The second is an assault on political romanticism that includes a broader attack on the new European bourgeoisie, which Schmitt characterizes as the historical bearer of the movement. The third strand is a defense of political conservatism and a refutation of the view that political romanticism is intrinsically linked with romanticism. Here Schmitt argues that the political romantic is tied not to positions but to aesthetics, and can therefore as easily become a Danton as a Frederick the Great. Guy Oakes's introduction places the book in historical context and also suggests its continuing relevance through his discussion of the latest outcropping of political romanticism in the late 1960s, intriguingly brought out in his example of Norman Mailer as a political romantic. When it comes to evaluating reductive hypotheses in metaphysics, supervenience arguments are the tools of the trade. Jaegwon Kim and Frank Jackson have argued, respectively, that strong and global supervenience are sufficient for reduction, and others have argued that supervenience theses stand in need of the kind of explanation that reductive hypotheses are particularly suited to provide. Simon Blackburn's arguments about what he claims are the specifically problematic features of the supervenience of the moral on the natural have also been (...) influential. But most discussions of these arguments have proceeded under the strong and restrictive assumptions of the S5 modal logic. In this paper we aim to remedy that defect, by illustrating in an accessible way what happens to these arguments under relaxed assumptions and why. The occasion is recent work by Ralph Wedgwood, who seeks to defend non-reductive accounts of moral and mental properties together with strong supervenience, but to evade both the arguments of Kim and Jackson and the explanatory challenge by accepting only the weaker, B, modal logic. In addition to drawing general lessons about what happens to supervenience arguments under relaxed assumptions, our goal is therefore to shed some light on both the virtues and costs of Wedgwood's proposal. Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. In Knowledge and Belief, Frederick Schmitt explores the nature and value of knowledge and justified belief through an examination of the dispute between epistemological internalism and externalism. Knowledge and justified belief are naturally viewed as belief of a sort likely to be true--an externalist view. It is also intuitive, however, to view them as an internal matter; justification must be accessible to the subject or constituted by the subject's epistemic perspective. The author argues against the view that internalism is (...) the historically dominant epistemology by examining closely the epistemological principles that underlie the treatment of skepticism in Plato, the Academic and Pyrrhonian skeptics, Descartes and Hume. Schmitt develops a sustained, detailed argument against many forms of internalism in favor of a reliabilist/externalist epistemology. His version of reliabilism, though strictly externalist, accommodates and explains the most durable intuitions alleged to support internalism. Knowledge and Belief assumes no knowledge of epistemology or its history. The Sociosexual Orientation Inventory (SOI; Simpson & Gangestad 1991) is a self-report measure of individual differences in human mating strategies. Low SOI scores signify that a person is sociosexually restricted, or follows a more monogamous mating strategy. High SOI scores indicate that an individual is unrestricted, or has a more promiscuous mating strategy. As part of the International Sexuality Description Project (ISDP), the SOI was translated from English into 25 additional languages and administered to a total sample of 14,059 people (...) across 48 nations. Responses to the SOI were used to address four main issues. First, the psychometric properties of the SOI were examined in cross-cultural perspective. The SOI possessed adequate reliability and validity both within and across a diverse range of modern cultures. Second, theories concerning the systematic distribution of sociosexuality across cultures were evaluated. Both operational sex ratios and reproductively demanding environments related in evolutionary-predicted ways to national levels of sociosexuality. Third, sex differences in sociosexuality were generally large and demonstrated cross-cultural universality across the 48 nations of the ISDP, confirming several evolutionary theories of human mating. Fourth, sex differences in sociosexuality were significantly larger when reproductive environments were demanding but were reduced to more moderate levels in cultures with more political and economic gender equality. Implications for evolutionary and social role theories of human sexuality are discussed.
